1. Legal notice

In accordance with Spanish Law 34/2002 on information society services and electronic commerce (LSSI), the owner of this website is:

Access to this website is free of charge and makes you a user, who accepts this legal notice. The texts, photographs, logos and design of the site belong to the owner or its suppliers and may not be reproduced without permission. The owner is not responsible for misuse of the site or for the content of third-party websites linked from it.

2. Terms of sale

How to place an order

The customer chooses products and sizes in the shop, adds them to the basket and sends the order by WhatsApp to 696 01 36 39. The order is not binding until KYARE Descanso confirms in writing (by WhatsApp or email) the availability, total price, delivery time and delivery method. That confirmation completes the contract.

Prices

Prices are shown in euros and include VAT. Any charges for delivery, assembly or removal of an old mattress are communicated before the order is confirmed. If a published price is obviously wrong by mistake, the customer will be told before confirmation and may accept the correct price or cancel at no cost.

Payment

Nothing is charged through the website. Payment is made by Bizum, bank transfer, or in cash or by card on delivery, as agreed when the order is confirmed.

Delivery

We deliver mainly in Fuengirola and the province of Málaga. The delivery time depends on the product and size and is given when the order is confirmed; it will be no more than 30 days unless otherwise agreed. If we cannot meet it, we will let the customer know, and they may cancel and get back what they have paid.

Made-to-measure products

Some items are made in special sizes or versions at the customer's request. This will be stated in the order confirmation.

3. Right of withdrawal and returns

As a consumer, you have the right to withdraw from your purchase within 14 calendar days of receiving the product, without giving any reason (articles 102 et seq. of Spanish Royal Legislative Decree 1/2007).

To exercise this right, tell us clearly by WhatsApp on 696 01 36 39, by email to kyaredescanso@gmail.com or by post to the address above. You may use the model form below, but it is not compulsory. We will refund everything you have paid, including standard delivery, within 14 days of receiving your notice, using the same payment method unless we agree otherwise. We may withhold the refund until we receive the product back. The direct cost of returning the goods is paid by the customer, and we will tell you the approximate amount.

Exceptions (article 103 of the same law): the right of withdrawal does not apply to

• products made to the customer's specifications or clearly personalised (for example, special sizes made to order);
• sealed products that are not suitable for return for health protection or hygiene reasons and have been unsealed after delivery (for example, mattresses, pillows, toppers or fillings whose protective plastic has been removed).

The customer is liable for any loss in value of the product if they have handled it more than necessary to establish its nature and how it works.

4. Guarantee

All products carry the 3-year legal guarantee from delivery against lack of conformity (articles 114 et seq. of Royal Legislative Decree 1/2007). In that case you may choose repair or replacement free of charge and, if neither is possible, a price reduction or termination of the contract. For any problem, write to us by WhatsApp or email with a photo of the issue and your order number.

In addition, many products have a manufacturer's commercial guarantee of 2 to 20 years, depending on the brand and model. We will tell you the guarantee for each product before confirming your order. This guarantee applies under the conditions set by each manufacturer and does not limit the legal guarantee.

Official complaint forms (hojas de reclamaciones) are available to consumers. You can also contact the consumer services of the Junta de Andalucía or your local town hall.

5. Privacy policy

What data we process: the data you send us when you place an order or make an enquiry by WhatsApp, phone or email: name, phone, email, delivery address and the products you order.

What for: to manage your order, delivery, payment and guarantee, and to answer your enquiries. We do not send advertising without your consent, and we do not make automated decisions.

Legal basis: performance of the sales contract or of the pre-contractual steps you request (article 6.1.b GDPR) and compliance with legal tax and consumer obligations (article 6.1.c).

How long: for as long as the business relationship lasts and, after that, for the legal retention periods (for example, 6 years for accounting and tax records).

Who we share it with: no one, except where required by law, the delivery company when needed for delivery, and the providers that give us services (website hosting, WhatsApp messaging by Meta Platforms, email by Google), which may process data outside the European Economic Area with the safeguards provided for in the GDPR.

Your rights: you can request access, rectification, erasure, objection, restriction or portability of your data by writing to kyaredescanso@gmail.com. If you feel your request has not been dealt with, you can complain to the Spanish Data Protection Agency (www.aepd.es).

6. Cookie policy

This website does not use analytics, advertising or third-party cookies. It only stores in your browser (local storage) the contents of your basket and your chosen language, so they are not lost when you change page. This is technical storage needed for the service you request and does not require consent. You can delete it at any time in your browser settings.
